Terms and Conditions for the Purchase of The SportSure Trading Programme, and use of the website www.sportsuretrading.com

Background

This agreement applies between you the User of the Web Site, and Waverley Media, the owner of this Web Site. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these Terms and Conditions, you should not purchase the SportSure Trading Programme, and if you have already purchased a subscription, you should stop using the Web Site immediately.

Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

The term 'you' refers to the user or viewer of our website.

• "Content"

means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

• "The Company"

means Waverley Media Ltd, of Waverley Farm, Waverley Lane, Farnham, Surrey, GU9 8EP;

"Markiteer" and "SportSure"

are brand names of Waverley Media Ltd;

• "The Programme"

Means your subscription to the SportSure Trading Programme, which is delivered via the website www.sportsuretrading.com

• "Service"

means collectively any online (paid or otherwise) facilities, tools, services or information that The Company makes available through the Web Site either now or in the future;

• "System"

means any online communications infrastructure that The Company makes available through the Web Site either now or in the future. This includes, but is not limited to, downloadable PDF or MP3, video, web-based email, message boards, webinars, live chat facilities and email links;

• "User"/"Users"

means any third party that accesses the Web Site and is not employed by The Company and acting in the course of their employment; and

• "Web Site"

means the website that you are currently using (www.SportSuretrading.com or http://www.simple-sports-trading-profits.com) and any sub-domains of these sites unless expressly excluded by their own terms and conditions;

"Members Area"

means areas of the website reserved for those who have made a purchase and contains downloadable content and any future additional services.

• "Subscription"

means the contract you have entered into with The Company to pay for the SportSure Trading Programme in 12 monthly instalments of £89.90 per month for the first three months and £149.90 per month for the following nine months.

Your Subscription to the SportSure Trading Programme

Your subscription will be processed from the debit or credit card details which you gave us when you purchased the SportSure Trading Programme. The subscription is processed automatically every 30 days. For clarity, this means that if you purchased your subscription on the 1st day of a 31-day calendar month, your 2nd payment will be processed on the 31st of the month. Each new module of the course will be delivered at the time of the successful payment.

30-day Money-Back Guarantee

The Sportsure Trading Programme has been sold to you with a 30-day Money-Back Guarantee. Specifically, this means that you may use the website for a full 30 days after purchasing your subscription, and if you decide within the 30 day period that you no longer wish to continue with your subscription you may cancel according to the terms shown below under 'Cancellation' and you will receive a refund of the initial £89.90 you have paid.

Cancellation

You may cancel your subscription to the SportSure Trading Programme at any point by sending an email to us at admin@sportsuretrading.com . To enable us to correctly identify your account, your email should contain the name under which you purchased your subscription, your SportSure website User Name, and your postcode.

Cancellation emails must be received during normal business hours, which are Monday - Friday, 9am to 5pm excluding UK Bank Holidays.

Any subscription payments processed outside of normal business hours will not be eligible for a refund unless your cancellation email is received during normal business hours the working day prior to the payment being processed. Payments due to be processed outside of these hours will only be refunded if cancellation emails are received prior to the payment being processed.

For clarity, this means that if your subscription payment is due to be processed on a Saturday, Sunday, or Bank Holiday, you must ensure that your email is sent before 5pm on the preceding working day.

Cancellations received outside normal business hours will not be processed until the following working day.

Refunds for payments made are available only under the 30-day Money-Back Guarantee. No other refunds are available for any reason whatsoever.

Intellectual Property

Unless specified by The Company, all Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of The Company, or our affiliates. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.

Unless given permission by The Company you may not print, reproduce, copy, distribute, store or in any other fashion re-use Content from the Web Site in any other capacity other than for personal use for the purpose of learning how to Sports Trade unless otherwise indicated on the Web Site or unless given express written permission to do so by The Company. Specifically you agree that: you will not use the Content of the Web Site for commercial purposes; you will not use distribute the content of the Web Site in any form whether verbal, electronic printed or other form to any third party; and you will not systematically copy Content from the Web Site with a view to creating or compiling any form of comprehensive collection, compilation, directory or database unless given express written permission to do so by a representative of The Company.

Third Party Intellectual Property

Where expressly indicated, certain Content and the Intellectual Property Rights subsisting therein belongs to other parties. This Content, unless expressly stated to be so, is not covered by any permission granted by these Terms and Conditions to use Content from the Web Site. Any such Content will be accompanied wherever possible by a notice providing the contact details of The Company and any separate use policy that may be relevant.

You may under no circumstances redistribute in any form whatsoever video, PDF or MP3 or any other content to any third party.

Fair Use of Intellectual Property

Material from the Web Site (except information, Videos, PDF or MP3 files or any other material supplied as part of your subscription) may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

Notices

All notices / communications shall be initially given to us by email to admin@sportsuretrading.com. Such notice will be deemed received on the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday. Subsequent communication will indicate whether notification by post to our premises is also required.

Law and Jurisdiction

These terms and conditions and the relationship between you and The Company shall be governed by and construed in accordance with the Laws of England and Wales and The Company and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
